Nicodemus, a Jewish teacher with a high position of leadership, is meeting secretly with Jesus.
Nicodemus has been waiting for a sign that God's promise of salvation through a savior will happen in his lifetime. But he does not yet believe in Jesus, as is emphasized by his coming to Jesus "by night". Speaking symbolically, Jesus outlines what it takes for salvation: to believe in Jesus as the one sent by God, and to be born again through baptism and the Holy Spirit. The same is true for people today.
Nicodemus most likely knew that to accept Jesus publicly would put him in bad standing with the other Jewish leaders. Sometimes, we must make choices that might make us look foolish to others.
